Elaine Stack Real Estate Pty Ltd has:

This privacy notice sets out how we may use information about you which we collect through your use of this website in particular and more generally. It is our wish that any such information is up-to-date and accurate and not incomplete, irrelevant or misleading so we ask that you request that we correct any lack of accuracy in any personal information we hold about you. If appropriate, we will correct such information held by us without cost to you.
From time to time we may receive information about you from you or from your professional associates. The information may be stored with a third party data storage provider. The personal information will be used as a basis on which to provide services to you.
We will collect personal information about you where it is reasonably necessary for our business and use and disclose your personal information, as you would expect, for the primary purpose (or to a related body corporate) for which it was collected or, if an exception applies under the law, for secondary purposes. With the exception of service providers who we pay to manage our computer systems and support or for marketing of our services, we do not provide or seek to commercialise your personal information to third parties.
We collect personal information about people or entities who:
request or receive services from us in respect of the leasing or management of a property or property portfolio; and
apply or are associated with people who apply, for a tenancy or are renting a property which we manage.
We also collect personal information about staff and about individuals who are or are associated with our contractors, business partners and service providers.
We use the personal information we collect for different purposes depending on the services provided;
For owners, we collect personal information for the purpose of managing your property or property portfolio and providing you with related services;
For landlords, we collect personal information for the purpose of managing tenancy changes arising from the change of ownership;
For a staff member or associated with a contractor or service provider, we collect personal information for purposes associated with your employment or managing the contract or services provided; and
For a tenant or prospective tenant, we collect personal information for the purpose of processing your tenancy application, preparing the lease or tenancy agreement, assessing the risk of providing you with a tenancy, collecting rental payments and other purposes related to the establishment or management of your tenancy, including the connection of utilities.
We always collect names and contact information. The additional types of personal information we collect depends on the type of service sought or provided;
For property owners, purchasers or prospective purchasers, we collect:
information about the property;
financial information; and
emergency contact information.
For tenancy applications, we collect:
identity verification information (e.g. driver licence or other ID details);
details of any current tenancy and/or rental history;
details of current home ownership;
emergency contact details;
if you are employed, details of current and previous employment (including information about your employer(s) and the income received)
if you are self-employed, information about your business and business advisors (e.g. solicitor or accountant);
if you are a student, information about your place and course of study, income and parents;
if you are in receipt of social security or other benefits, details of the type and amount of benefit;
details of vehicle and pet ownership if relevant; and
names and contact details for referees.
For new or established tenancies, we collect:
information about your use of the property (eg for maintenance or utility services); and
sensitive or health information (eg if there are special circumstances that you would want considered by the property manager or owner).
If we disclose personal information to a recipient outside of Australia, which is not usual in our practice, we will take such steps as are reasonable in the circumstances to ensure that the overseas recipient does not breach the APPs. Please note that this does not apply to personal information which is routed through servers that may be outside Australia as the APPs refer to this as a “use” not a “disclosure” of information.
You have the right to access your personal information, subject to the exceptions allowed by law. If you would like to do so please let us know and we will, subject to our right to refuse such a request in certain situations, provide it within a reasonable period of time. We reserve the right to impose a charge for giving access to requested personal information
We ask that you please contact us if you have any complaints in relation to the handling or use of your personal information. In particular, the relevant law provides that you should:
record any complaint in writing to us;
we should be given a reasonable time (usually 30 days) to respond; and
